1. Acceptance of Terms
By accessing or using Digital Linx Hosting services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services. These Terms apply to all visitors, users, and customers of Digital Linx Hosting.
Digital Linx Hosting reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our Services after any modifications constitutes acceptance of the revised Terms.
2. Services Description
Digital Linx Hosting provides virtual private server (VPS) hosting, dedicated server hosting, and related infrastructure services. Our Services include:
- KVM-based Virtual Private Servers
- Dedicated bare-metal servers
- DDoS protection services
- Network connectivity and bandwidth
- Technical support services
Service specifications, features, and pricing are subject to change. Current offerings are displayed on our website at the time of purchase.
3. Account Registration
To use our Services, you must create an account and provide accurate, complete, and current information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
- Ensuring your contact information remains current
You must be at least 18 years of age to create an account and use our Services. By registering, you represent that you meet this age requirement.
4. Payment Terms
All Services are billed in advance on a monthly basis unless otherwise specified. Payment is due upon invoice generation. We accept payment via:
- Credit/Debit Cards (Visa, MasterCard, American Express, Discover)
- PayPal
- Bank Transfer (for qualifying accounts)
- Cryptocurrency (Bitcoin, subject to availability)
Failure to pay invoices within 7 days of the due date may result in service suspension. Accounts with invoices outstanding for more than 14 days may be terminated, and all data may be permanently deleted.
All prices are in United States Dollars (USD) unless otherwise specified. You are responsible for any applicable taxes, duties, or government-imposed fees.
5. Service Level Agreement
Digital Linx Hosting guarantees 99.9% network uptime for all Services. This excludes scheduled maintenance, which will be announced at least 48 hours in advance when possible.
In the event of downtime exceeding our SLA, eligible customers may request service credits. Credit requests must be submitted within 7 days of the incident. Credits are calculated as follows:
- 99.0% - 99.9% uptime: 10% credit
- 95.0% - 99.0% uptime: 25% credit
- Below 95.0% uptime: 50% credit
Credits are applied to future invoices and are not redeemable for cash.
6. Acceptable Use Policy
You agree to use our Services only for lawful purposes. The following activities are strictly prohibited:
- Illegal activities of any kind
- Distribution of malware, viruses, or harmful code
- Phishing, fraud, or identity theft
- Unauthorized access to systems or networks
- Distribution of child exploitation material
- Spam or unsolicited bulk email
- Copyright infringement or intellectual property theft
- DDoS attacks or network abuse
- Cryptocurrency mining without prior authorization
- Running open proxies or TOR exit nodes without approval
Violation of these policies may result in immediate termination without refund. We reserve the right to cooperate with law enforcement agencies regarding illegal activities.
7. Resource Usage
VPS and dedicated server resources are allocated as specified in your service plan. You agree not to:
- Exceed allocated bandwidth limits
- Abuse CPU, memory, or I/O resources in ways that affect other customers
- Run processes that degrade network performance
- Attempt to access resources not allocated to your account
We reserve the right to throttle, suspend, or terminate services that negatively impact our infrastructure or other customers.
8. Data and Backups
You are solely responsible for maintaining backups of your data. While we may provide backup services, these are offered as a convenience and should not be relied upon as your only backup solution.
Digital Linx Hosting is not responsible for any loss of data, regardless of cause. We strongly recommend maintaining independent backups of all critical data.
9. Intellectual Property
You retain all rights to content you upload to our Services. By using our Services, you grant Digital Linx Hosting a limited license to host and transmit your content as necessary to provide the Services.
Digital Linx Hosting and associated logos, trademarks, and service marks are the property of Digital Linx Hosting. You may not use our branding without prior written consent.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITAL LINX HOSTING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.
Our total liability for any claim arising from or related to these Terms or our Services shall not exceed the amount paid by you for Services during the three (3) months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Digital Linx Hosting, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from:
- Your use of our Services
- Your violation of these Terms
- Your violation of any third-party rights
- Content you upload or transmit through our Services
12. Termination
Either party may terminate Services at any time. Upon termination:
- You remain responsible for any outstanding invoices
- We may delete your data after a grace period of 7 days
- Refunds, if applicable, will be processed per our Refund Policy
We reserve the right to terminate accounts immediately for violations of these Terms or our Acceptable Use Policy.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Missouri.
